General terms and conditions of Sale

1. GENERAL

The goods offer on the sonego.ch online shop is aimed at customers resident in Switzerland, with delivery address in Switzerland.

These General Terms and Conditions of Sale (hereinafter GTCS) are valid for all purchases of products and/or goods on the sonego.ch online shop owned by Gilbox Sagl.

Offers of products and services published online are valid as long as they are visible on the site and while stocks last. The images on the site are provided for information purpose. Gilbox Sagl disclaims any responsibility for any errors or inaccuracies relating to images, descriptive texts or availability.

2. PRICES

The indicate don the website prices are exclusively expressed in Swiss Francs (CHF). They include VAT (7.7%) and do not include shipping costs and any packaging that will be billed separately.

Gilbox Sagl reserves the right to change the prices at any time. The invoiced to the customer at the time of the order prices remain unchanged. Any promotional discounts offered on the site can be added to other discounts, unless otherwise specified.

There are possibilities of price differences, promotions or discounts of the products in the shops. It do not give rise to any claim of price adjustment or voucher.

3. CONTRACT CONCLUSION

The products and prices published in the online shop are valid as an offer.

The request to conclude a purchase contract derives from the Customer following the completion of the order and the click of the "Buy Now" button. In this way the customer is considered bound by the purchase contract. The same is considered closed only after the express acceptance by Gilbox Sagl, as better indicated in the following paragraph (§4. Ordering).

By sending the order, the Customer receives an automatically generated and sent to the indicated e-mail address order confirmation. The receipt of the order confirmation does not imply any confirmation that the product is actually available or can be delivered. The order confirmation simply informs the customer that the order has been received and will be processed.

4. THE ORDER

The order delivery by the customer implies full and complete acceptance of these General Terms and Conditions of Sale, without reserve, except other terms or conditions.

The order is effective only after the express acceptance by Gilbox Sagl by means of an e-mail confirming the purchase, with the delivery confirmation or with the actual product delivery.

The sales contract is considered stipulated only for the products explicitly indicated in the order acceptance and/or delivery confirmation e-mail. The total or partial non-acceptance of the order involves the refund of the total paid amount or of the undelivered part of the order.

The customer has the possibility to identify and correct entry errors before order delivery.

5. PAYMENT

The invoice price is the price indicated on the confirmation of the order, sent to the customer at the time of the order. The accepted payment methods are: Paypal, Credit Cards of the EuroCard /MasterCard, Visa, American Express, Postcard, PostFinance.

All payment transactions are made in the protected area ("https: //") according to the highest possible security standard. The data recorded by Gilbox Sagl constitute the proof of the set of transactions carried out between Gilbox Sagl and its customers. The data recorded by the payment system constitute the proof of financial transactions. The order is charged to the bank account or to the card used for payment at the time of delivery.

The products are property of Gilbox Sagl up to the full payment of the amount indicated on the invoice, respectively in the purchase confirmation e-mail.

6. SHIPMENT

Gilbox Sagl limits the shipments to the Swiss territory and better to the address indicated by the customer at the time of purchase. Any shipments outside of Switzerland required by the customer, are to be arranged separately.

Gilbox Sagl is considered to have fulfilled its obligations when the delivery of the goods is forwarded to the courier. Therefore, from that moment Gilbox is not liable for any partial or total damage, loss or stealing of the goods. All these risks are assumed by the Customer.

7. REPLACEMENT, REFUND, WARRANTY AND CLAIMS

It is the Customer's responsibility to check the status of the goods at the time of delivery within a reasonable period of time.

Any complaints related to defective goods and/or incomplete services, as well as returns, must be immediately presented by the Customer directly to Gilbox by email to sales@sonego.ch.

Otherwise, after 8 days from the receipt of the shipment or from the collection at the stores, the goods are considered accepted by the customer, without any reservation.

8. CONDITIONS FOR RETURN

Except for specific conditions, the customer can exercise the right of return.

It is up to the Customer to verify the goods upon receipt and communicate any defects or differences respect to his order.

It is possible to return or replace the purchased goods by presenting the proof of purchase. Can be return or replace only unused, clean and undamaged goods, intact and still with the original label and packaging. Items that are not intact, dirty or have suffered damage attributable to the customer generally are not accepted.

The legal conditions are in accordance with the art. 201 CO. Returns are possible within 7 days of receipt of the order or collection at the stores. If the customer cannot present the confirmation of receipt, the 7-day period starts from the order delivery.

In case of return of the goods, the shipping costs as well as all the delivery risks are on the customer. The goods can be returned by mail with the special label present inside the package or free of charge at the Sonego Calzature sale points.

In the case of free returns at a Sonego Calzature sales point, the goods must be presented to the respective customer service, provided with a delivery note or order confirmation. Please note that the reimbursement will be made on in the same way on which the purchase payment has been done and therefore cannot take made by cash.

Once the goods have been received, Gilbox Sagl verifies the returned items and decides, whether to make the full, partial or non-refundable refund, on dependence of the state of the goods. The refund will be made within 10 days of receipt.

The reimbursement concerns only the value of the returned goods. Any shipping costs incurred will not be refunded.

9. REPLACEMENT

The ordered goods can be changed r replaced only in the Sonego Calzature stores after receipt of the shipment or by post, with the charge of the shipping costs to the customer. The goods can be changed only if not used, clean, without damage and in the original packaging. For the goods replacement one should go to the counter of the reference department in the Sonego Calzature store. The replacements are possible within 7 days from receipt of the order or from collection at the stores. If the customer cannot present the confirmation of receipt, the 7-day period starts from the order delivery date.

If the supplied goods are damaged, please proceed as for the returns.

10. WARRANTY

Warranty services must be dealt with at the Sonego Calzature sales point, at the counter of the department in charge, or there should be opened a practice by sending an e-mail to sales@sonego.ch.

The sales invoice is required for the warranty request.

The warranty replacement or repair does not involve any extension of the original warranty period.

11. DATA PROTECTION

The collection and processing of personal data of customers by Gilbox Sagl are indicated in a separate data protection information, which is an integral part of these GTCS.

For the order on the online shop are required the exact data about the customer's name, address and payment, as well as the e-mail address for order and the shipment confirmation sending.

The customer also expressly accepts the use of their data for marketing purposes directed by Gilbox Sagl.

12. RESOLUTORY CLAUSE

The total or partial non-execution by the customer of one of his obligations and non-compliance with a payment deadline will place Gilbox Sagl in the condition of: being able to demand payment of the sum due, suspending all deliveries, withdrawing from the present contract.

13. APPLICABLE RIGHTS AND DISPUTES

This contract is governed by Swiss law, with the exception of the rules of private international law. The exclusive legal forum is the Court of Lugano.

14. MODIFICATIONS OF THE GENERAL SALES CONDITIONS AND RESCUE CLAUSE

Gilbox Sagl reserves the right to modify the GTCS any time. The change can also be made by Internet publication. Any changes to the GTCS are to be considered accepted as soon as the customer requests additional services from Gilbox Sagl.

If one or more provisions contained in this GTCS are invalid or illegal, the legality and feasibility of the remaining provisions contained are not affected. In this case the parties undertake to validly regulate the invalid or illegal disposition.
